Mira — лічильник калорій та харчування

Ці Умови використання («Умови») є договором між вами та Максимом Таранюком (ФОП, Україна) — розробником застосунку Mira («ми», «застосунок», «Mira»). Встановлюючи або використовуючи Mira, ви підтверджуєте, що прочитали та погоджуєтеся з цими Умовами та Політикою конфіденційності. Якщо ви не згодні — не використовуйте застосунок.

1. Опис сервісу

Mira — це застосунок для обліку калорій і харчування з функціями розпізнавання їжі за фото, AI-асистента, синхронізації активності та відстеження прогресу. Частина функцій безкоштовна, частина доступна за платною підпискою (див. розділ 4).

2. Не медичний сервіс

Важливо. Mira не є медичним сервісом і не надає медичних, дієтологічних чи інших професійних порад. Розрахунки калорій, макросів і рекомендації мають виключно інформаційний характер і можуть бути неточними. Mira не призначена для діагностики, лікування чи запобігання будь-яким захворюванням. Перед зміною харчування, фізичних навантажень чи за наявності захворювань проконсультуйтеся з лікарем або кваліфікованим фахівцем. Ви використовуєте застосунок на власний розсуд і відповідальність.

3. Обліковий запис

Ви відповідаєте за збереження доступу до свого облікового запису та за дії, що відбуваються під ним.
Ви зобов'язуєтеся надавати правдиву інформацію та підтримувати її актуальність.
Застосунок призначений для осіб віком від 13 років (а в ЄС — від 16 років, якщо інше не передбачено законом).
Ви можете будь-коли видалити обліковий запис у застосунку (Налаштування → Видалити акаунт) або на сторінці видалення акаунта.

4. Підписки та платежі

Mira працює за моделлю freemium. Платна підписка (наприклад, рівні PRO / Max) відкриває розширені функції — як-от збільшені ліміти AI-розпізнавання та чату, додаткові звіти й аналітику та відсутність реклами.

Оплата. Підписки купуються та оплачуються через ваш обліковий запис Apple ID (App Store) або Google (Google Play). Кошти списуються при підтвердженні покупки.
Автопоновлення. Підписка автоматично продовжується наприкінці кожного періоду, якщо ви не вимкнете автопоновлення щонайменше за 24 години до завершення поточного періоду. Списання за наступний період відбувається протягом 24 годин до його початку.
Керування та скасування. Керувати підпискою та вимкнути автопоновлення можна лише в налаштуваннях вашого облікового запису App Store або Google Play — ми не можемо зробити це за вас.
Повернення коштів. Повернення регулюється правилами Apple та Google; запити на повернення подаються відповідно до їхніх політик, а не через нас.
Ціни. Актуальна ціна та період відображаються в застосунку перед покупкою. Ми можемо змінювати ціни на майбутні періоди з попереднім повідомленням.

Для підписок, придбаних в App Store, застосовується стандартна ліцензійна угода Apple (Apple Standard EULA), доступна за посиланням: apple.com/legal/internet-services/itunes/dev/stdeula. У разі суперечності між цими Умовами та Apple Standard EULA щодо застосунку для iOS переважну силу має Apple Standard EULA.

5. Прийнятне використання

Ви погоджуєтеся не: порушувати закон; намагатися отримати несанкціонований доступ до сервісу чи даних інших користувачів; перешкоджати роботі сервісу; завантажувати незаконний, шкідливий чи чужий контент без права на нього; використовувати застосунок для автоматизованого збору даних поза дозволеними функціями.

6. Ваш контент

Контент, який ви додаєте (зокрема фото їжі, нотатки), залишається вашим. Ви надаєте нам обмежену ліцензію зберігати й обробляти цей контент — у тому числі передавати фото AI-провайдеру — виключно для надання функцій застосунку. Обробку фото описано в Політиці конфіденційності.

7. Інтелектуальна власність

Сам застосунок, його дизайн, логотипи, тексти та програмний код належать розробнику й захищені законом. Ці Умови не передають вам жодних прав на них, окрім права користуватися застосунком згідно з Умовами.

8. Відмова від гарантій

Застосунок надається «як є» та «як доступно», без жодних гарантій — явних чи неявних, зокрема щодо точності даних про харчування, безперебійності чи придатності для певної мети. Ми не гарантуємо, що сервіс працюватиме без помилок чи перерв.

9. Обмеження відповідальності

У максимально дозволеному законом обсязі розробник не несе відповідальності за непрямі, випадкові чи опосередковані збитки, втрату даних чи прибутку, що виникли внаслідок використання або неможливості використання застосунку. Ніщо в цих Умовах не обмежує відповідальності, яку не можна обмежити за законом.

10. Зміни та припинення

Ми можемо змінювати, призупиняти чи припиняти роботу застосунку або окремих функцій, а також оновлювати ці Умови. Про істотні зміни ми повідомимо в застосунку або іншим способом. Подальше використання після набрання змін чинності означає вашу згоду. Ми можемо призупинити чи закрити обліковий запис у разі порушення цих Умов.

11. Застосовне право та контакти

До цих Умов застосовується законодавство України, без урахування колізійних норм. З питань щодо Умов звертайтеся:

Terms of Service

Mira — Calorie & Food Tracker

These Terms of Service ("Terms") form an agreement between you and Maksym Taraniuk (sole proprietor, Ukraine), the developer of the Mira app ("we", "the App", "Mira"). By installing or using Mira, you confirm that you have read and agree to these Terms and the Privacy Policy. If you do not agree, do not use the App.

1. The Service

Mira is a calorie and nutrition tracking app with photo food recognition, an AI assistant, activity sync, and progress tracking. Some features are free; others require a paid subscription (see Section 4).

2. Not a Medical Service

Important. Mira is not a medical service and does not provide medical, dietetic, or other professional advice. Calorie and macro calculations and recommendations are for informational purposes only and may be inaccurate. Mira is not intended to diagnose, treat, or prevent any disease. Consult a physician or qualified professional before changing your diet or exercise, or if you have a medical condition. You use the App at your own discretion and risk.

3. Your Account

You are responsible for safeguarding access to your account and for activity that occurs under it.
You agree to provide accurate information and keep it up to date.
The App is intended for users aged 13 and over (16 and over in the EU, unless local law provides otherwise).
You may delete your account at any time in the App (Settings → Delete account) or via the delete account page.

4. Subscriptions & Payments

Mira uses a freemium model. A paid subscription (e.g. PRO / Max tiers) unlocks advanced features such as higher AI recognition and chat limits, additional reports and analytics, and an ad-free experience.

Billing. Subscriptions are purchased and billed through your Apple ID (App Store) or Google (Google Play) account. You are charged upon confirming the purchase.
Auto-renewal. Your subscription renews automatically at the end of each period unless you turn off auto-renewal at least 24 hours before the current period ends. The renewal charge is applied within 24 hours before the new period begins.
Managing & canceling. You can manage your subscription and turn off auto-renewal only in your App Store or Google Play account settings — we cannot do this for you.
Refunds. Refunds are governed by Apple's and Google's rules; refund requests are submitted under their policies, not through us.
Pricing. The current price and period are shown in the App before purchase. We may change prices for future periods with prior notice.

For subscriptions purchased on the App Store, Apple's Standard End User License Agreement (Apple Standard EULA) applies and is available at: apple.com/legal/internet-services/itunes/dev/stdeula. In case of any conflict between these Terms and the Apple Standard EULA regarding the iOS app, the Apple Standard EULA prevails.

5. Acceptable Use

You agree not to: break the law; attempt to gain unauthorized access to the service or other users' data; interfere with the service's operation; upload unlawful, harmful, or third-party content you have no rights to; or use the App for automated data collection beyond its intended features.

6. Your Content

Content you add (including food photos and notes) remains yours. You grant us a limited license to store and process this content — including sending photos to our AI provider — solely to provide the App's features. Photo processing is described in the Privacy Policy.

7. Intellectual Property

The App itself, its design, logos, text, and code belong to the developer and are protected by law. These Terms grant you no rights in them other than the right to use the App in accordance with these Terms.

8. Disclaimer of Warranties

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including as to the accuracy of nutrition data, uninterrupted operation, or fitness for a particular purpose. We do not warrant that the service will be error-free or uninterrupted.

9. Limitation of Liability

To the maximum extent permitted by law, the developer is not liable for indirect, incidental, or consequential damages, or loss of data or profit, arising from your use of or inability to use the App. Nothing in these Terms limits liability that cannot be limited by law.

10. Changes & Termination

We may modify, suspend, or discontinue the App or any features, and may update these Terms. We will notify you of significant changes in the App or by other means. Continued use after the changes take effect constitutes acceptance. We may suspend or close an account that breaches these Terms.

11. Governing Law & Contact

These Terms are governed by the laws of Ukraine, without regard to conflict-of-law rules. For questions about these Terms, contact:
